In this document, the following terms and definitions are used equally in both the singular and plural, in the following meanings: 1.1. “Agreement” — a public agreement (offer) addressed to any individual and/or individual entrepreneur and/or legal entity to conclude a public agreement with him for the provision of services and/or related services by selling a ticket on the terms set forth therein. Posted by the Organizer at: https://realty-summit.od.ua/ (hereinafter referred to as the Agreement or the Offer depending on the context). 1.2. “Acceptance” — full confirmation and unconditional acceptance by the Buyer of all the terms of this Offer. 1.3. “Site” - realty-summit.od.ua/ - an Internet site, which is a trading platform that provides the Buyers with the opportunity to purchase a Ticket to the Event. 1.4. "Organizer" - Private enterprise "Dominanta-D", EDRPOU code: 33509418, which carries out independent professional activities in the provision of services by organizing the Event. The Organizer has all the necessary rights to organize and hold the Event. 1.5. "Buyer" - an individual who has reached the age of majority in accordance with the legislation of the country of his citizenship and/or an individual entrepreneur and/or a legal entity to whom the Organizer provides services under the terms established by this Offer. 1.6. "Speech" (listener) - a person who directly attends the Event on the Ticket, presenting it for control, and consumes the services. Buyer or other person. 1.7. "Ticket" - a document in electronic and digital form confirming the conclusion of an agreement between the Buyer and the Organizer and the right of the Spectator to attend (pass, view, listen) to the Organizer's Event. Contains a barcode, cost, name of the Event, place, date and time of its holding and other additional information of a legal or technical nature. 1.8. “Barcode” – a code generated by the system that is assigned to the Ticket and identifies it. 1.9. “Nominal Ticket Price” – the cost of the Ticket set by the Organizer for all Buyers. 1.10. “Ticket Price” (order) – the total amount of the Nominal Ticket Price. 1.11. “Event” – cultural and entertainment events held by the Organizer and aimed at organizing the provision of services in one place and time, united by a single purpose and nature, which can be visited only upon presentation of a special document – an Electronic Ticket. 1.12. "Order" - An Event for which the Buyer wishes to purchase a Ticket from the Organizer, for which the Buyer: agrees to all the terms and conditions of the Offer, chooses a seat/seats from those available for sale on the Site, a method of payment for the Ticket; and for which the Buyer has received confirmation from the Organizer of the cost of the Ticket, the possibility of its booking/reservation/purchase, the amount of Related Services, and has made such booking/reservation/payment. The Order, among other things, contains the total amount, date and time of the order/payment and other related data. The Order is formed taking into account the amount of established taxes and fees established by the current legislation of Ukraine. 1.13. "Establishment" - means a premises and/or other designated facility for holding the Event. 1.14. "Service" - a cultural service provided to the Buyer by the Organizer within the framework of the Event, with the direct presence of the Spectator at such Event. 1.15. "Ancillary services" - services that are inextricably linked to the Ticket sales procedure and that are provided by the Organizer to compensate for the cost of financial transactions (acquiring) and consumed by the Buyer directly during such Ticket sale. 1.16. "Rules of Staying in the Establishment/Event" - are the norms and rules of the Establishment/Organizer established for Spectators during their stay in the Establishment/Event. 1.17. "Personal data" - is information or a set of information about an individual who is identified or can be specifically identified with their help (including but not limited to: last name, first name, gender, contact phone number, city).
2.1. This Agreement (Offer) regulates the terms and procedure for the sale of Tickets, as well as the rights and obligations arising in connection with this for the Buyer and the Organizer. 2.2. The sale of Tickets to the Buyer (including Electronic Tickets) is carried out exclusively on the terms of this Offer and only in the event of full and unconditional acceptance of all terms of this Offer by the Buyer (acceptance of the Offer). Partial Acceptance, as well as Acceptance on other terms, is not allowed. The Buyer's use of the Organizer's services on the terms proposed in this Offer indicates the conclusion of this Agreement between them. 2.3. If the Buyer does not accept the terms of this Offer in full, the sale of Tickets (including Electronic Tickets) is not carried out. Tickets purchased by the Buyer cannot be returned if the Buyer disagrees with the terms of this Offer. Refunds for Tickets purchased by the Buyer are possible only in accordance with the procedure and under the conditions established by this Offer. 2.4. When purchasing Tickets from the Organizer by a legal entity or an individual entrepreneur, payment for Tickets is made only by transferring funds to the Organizer's bank account based on the invoice issued by the Organizer. 2.5. The provisions of this Offer may be changed by the Organizer without any prior notice and/or consent of the Buyers. The new version of the Offer comes into force from the moment of its placement (publication) on the Organizer's Website, unless otherwise provided for by the new version of the Offer. The Buyer's use of the Organizer's services after making changes to the text of the Offer means Acceptance of the Offer taking into account the changes made. 2.6. The Organizer has the right to terminate the Offer at any time without prior notice to the Buyer in the event of the latter's violation of the terms of this Offer and other rules.
3.1. On the terms specified in this public offer (Offer), as well as the essential terms stipulated and confirmed by the parties in a separate Order: 3.1.1. a service agreement is concluded between the Organizer and the Buyer, under which the Organizer undertakes to grant the Buyer the right (access) to visit the Event as a Spectator and to consume the services for which the Buyer will purchase a Ticket from the Organizer, and the Buyer undertakes to pay the Organizer the cost of such services (hereinafter referred to as the Service Agreement).
4.1. This Offer contains conditions upon agreement and compliance with which the Buyer may purchase services by purchasing a Ticket from the Organizer, and the effect of which extends to all methods of placing an Order by the Buyer and forms of payment for it. 4.2. As a result of purchasing a Ticket to the Event, an Agreement for the provision of services specified in the Ticket is concluded between the Buyer and the Organizer. The Ticket to the Organizer's Event purchased from the Organizer confirms the Organizer's obligations to the Buyer: to ensure the Spectator's passage during the Event period specified in the Ticket and to the location of the Institution, for the purpose of the Spectator's consumption of services. 4.3. To consume services, the Buyer / Spectator must take all measures dependent on him, in particular: 4.3.1. order and pay for the Ticket (the procedure is described in a separate section of this offer). 4.3.2. receive the Ticket in the manner specified in section 8 of the Offer. 4.3.3. arrive on time at the Venue where the Event is held, pass security (present the Ticket for redemption), and, if the Ticket indicates a separate seat, take it. Unless otherwise specified in the Organizer's terms and conditions, which will be stipulated when ordering the Ticket. Spectators' access to the Venue where the Event will be held opens one hour before the scheduled start of the Event, and lasts until the actual start of the Event. It is possible to pass security at the Event with an unpaid Ticket only once (the Ticket can be scanned only once - after that it becomes invalid). If the Spectator, after passing security, leaves its boundaries, re-passing with a redeemed Ticket and the Spectator's admission to the Event will be impossible, even when presenting a redeemed Ticket. The scheduled start of the Event is stipulated when ordering the Ticket, and is indicated on the Ticket. In the event that the Spectator, due to his own fault or initiative, did not arrive on time at the Establishment, and/or did not pass the control, and/or left the Establishment before the beginning or end of the Event, the Organizer, provided that he held the Event, is considered to have properly fulfilled the terms of the Service Agreement (provided the Buyer with access to the Event and the opportunity to consume services), and is not liable to the Spectator and/or the Buyer for the failure of such Spectator and/or Buyer to receive services (in this case, the money is not returned to the Buyer under any circumstances). 4.3.4. not to leave the Establishment on his own initiative before the end of the Event. If the Spectator, on his own initiative, left the Event before its end, and provided that the Event corresponds to that specified in the Ticket, the services are considered to have been provided/consumed by the Buyer/Spectator in full and properly (in this case, the money is not returned to the Buyer under any circumstances). 4.3.5. not to violate the Rules of Stay in the Facility/Event established by the Organizer and/or the Facility. Such Rules of Stay in the Facility/Event are partially specified in the Ticket and may be supplemented/changed by the Organizer and/or the Facility;
5.1. By placing an order, the Buyer confirms that he is familiar with all the terms and conditions of this Offer, the Rules of Staying at the Establishment/Event, that such terms are understandable to him, and he undertakes to properly and fully comply with and fulfill them. 5.2. Tickets are ordered in the following way: 5.2.1. online: from a web browser, by going to the Site, and completing the Ticket Ordering and Payment procedure; 5.3. The Organizer's Ticket Ordering Procedure (agreement and confirmation of each party's consent to all essential and additional terms and conditions of the concluded contracts) involves the parties completing the following mandatory stages: 5.3.1. the Buyer's selection of a specific seat for the selected Event, the Ticket for which he wishes to purchase, and which is in the Organizer's free sale (i.e. which is not reserved, not booked, and not sold at the time of placing the Order); 5.3.2. confirmation by the Buyer of his consent to purchase the Ticket selected by him by confirming his agreement with the finally formed amount of the Order (Ticket Price). The Buyer makes such confirmation by clicking on the appropriate button containing confirmation of consent when ordering through the Site. Such confirmation by the Buyer is considered his full agreement with the terms of purchase of the selected services of the Organizer. By making such confirmation, the Buyer thereby unequivocally confirms that he has timely and in advance received the necessary, accessible, reliable and unambiguous information provided for by the Law of Ukraine "On Protection of Consumer Rights" about the services, which provides the possibility of a conscious and competent choice, and such information is completely understandable, acceptable and sufficient for him in form and volume. 5.4. After paying for the Order and receiving the Ticket, a Service Agreement is concluded between the Organizer and the Buyer. Such services can be received by the Spectator (i.e. the Buyer, or a third party, in the event that the Buyer concludes the agreement in favor of a third party), who presents a valid Ticket for inspection at the entrance to the Facility where the Event will be held.
6.1. The Order is considered to be made, and this Offer is fully and voluntarily accepted (Accepted) by the Buyer on the terms and conditions stipulated in the Offer and the specific Order, after performing all the actions stipulated in clause 5.3. of this Offer, at the time of full payment by the Buyer of the price of the Ordered Tickets. 6.2. By accepting this Offer, the Buyer guarantees and confirms that he/she received in a timely manner (i.e. before purchasing the Ticket) the necessary, understandable, accessible and reliable information about the services ordered by him/her, including the name of the Event, the names (pseudonyms) of the speakers, the Nominal Price of the Ticket, the Ticket Price, the procedure and conditions for its purchase, use, return, bank commission and payment system fees for money transfers, as well as about the identity of the Organizer, and that such information was correctly perceived by him/her and allowed him/her to make a conscious and competent choice and place the Order.
7.1.1. To independently obtain information from open sources about the cost of Tickets for Events, the amount of the Service Fee and the cost of Additional Services from ticket operators, and based on the information received, to make a decision to purchase Tickets from the Organizer. 7.1.2. To receive information about the rules for selling Tickets, available Ticket categories and other information about the Events that the Organizer possesses using the methods specified on the Site.
7.2.1. To provide only complete and accurate information about himself, the selected payment method and other data specified when ordering a Ticket. In the event that the Buyer's Order is not fulfilled/is fulfilled incorrectly, inaccurately, or incompletely due to erroneous, inaccurate or incomplete information about the Buyer, his details provided by the Buyer when placing the order or paying for it - the Organizer is not responsible for non-fulfillment or improper fulfillment of the obligations assumed under the relevant Order. 7.2.2. To read in detail all the rules of this Offer and accept them when purchasing a Ticket, as well as all additional rules governing the relations of the Parties under this Offer. 7.2.3. The Buyer has the right to refuse to purchase a Ticket from the Organizer until the payment for the Order is made in accordance with the conditions stipulated in this Offer. Such refusal will entail the termination of all obligations of the Organizer to the Buyer. 7.2.4. The Buyer alone bears all responsibility for minor children in whose interests he purchases a Ticket. 7.2.5. Pay the full cost of the Tickets. 7.2.6. Comply with the Rules of Staying in the Institution/Event. 7.2.7. Do not post, publish, transmit or distribute messages that may be of a criminal nature or cause any harm to the Organizer and other Buyers. 7.2.8. In order to prevent the possibility of using the purchased Ticket by a third party, the Buyer/Veteran is obliged to make all efforts within their power to prevent such Ticket or the information on it from reaching third parties, including not making copies of the Ticket and in no case disclosing the Ticket Barcodes.
7.3.1. Require the Buyer to comply with all procedures for placing and paying for the Order in accordance with the rules set forth in this Offer. 7.3.2. In the event of the Buyer's refusal to accept the terms of this Offer, refuse to sell the Buyer a Ticket. 7.3.3. Require the Buyer to fulfill the obligations imposed on the Buyer/Voter, according to the terms of this Offer. 7.3.4. Refuse to sell the Buyer a Ticket if the Buyer violates the terms of the Order placed by him. 7.3.5. Change or terminate this Offer unilaterally. Such change or suspension of this Offer does not apply to Orders placed before such changes that were accepted for execution. 7.3.6. Modify any software of the Site. To stop the operation of software that ensures the functioning of the Site, in order to detect malfunctions, errors and failures, as well as to carry out preventive work and prevent unauthorized access. The Organizer shall not be liable for the inoperability of communication channels through which the Buyer connects to the Site. 7.3.7. For failure by the Buyer to comply with any of the clauses of this Offer, to refuse to conclude a Service Agreement. 7.3.8. To involve third parties to fulfill their obligations under this Agreement. 7.3.9. To change prices for unordered (unreserved) and unpaid Tickets. 7.3.10. To make changes to the location of the stage and spectator areas in the Facility where the Event is held.
7.4.1. Provide the Buyer/Specifier, in whose interests the Buyer has concluded the Agreement for the provision of services at the place and time specified in the Ticket. 7.4.2. Provide the Buyer with the necessary information about the conditions of stay in the Facility/Event. 7.4.3. The Organizer undertakes to provide a pass to the Spectator who presents a valid Ticket to the Event at the entrance to receive services, provided that such Spectator complies with the Rules of Stay in the Facility/Event. A Ticket purchased by the Buyer from the Organizer is considered valid, provided that it is not used (redeemed) by anyone before the Spectator passes the control, or if it is not canceled and returned to free sale.
8.1. Tickets are transferred to the Buyer only after full payment of the Ticket Price and Related Services at the Buyer's choice in the following way: the Organizer sends a letter to the Buyer's e-mail address, as an attachment to the letter is an Electronic Ticket form with a unique Barcode.
9.1. When purchasing an Electronic Ticket, the Buyer in any case undertakes to provide his/her valid e-mail address, telephone number, and also to indicate his/her surname and name of the Ticket recipient (in some cases, passport data, if there are such requirements in accordance with the Laws of Ukraine and/or the Organizer). In case of failure to provide such information (valid e-mail addresses, telephone numbers, surname and name of the Buyer and the Ticket recipient, passport data), as well as in case of providing false or invalid information, the Organizer has the right to refuse the Buyer to purchase an Electronic Ticket. 9.1.1. If the Buyer provides (enters) inaccurate information about himself/herself when purchasing a Ticket, then in this case the Organizer does not bear any responsibility for the quality and timeliness of the provision of services. 9.2. The Buyer accepts and agrees that he is fully responsible for reporting an incorrect or invalid e-mail address. 9.3. The Electronic Ticket is sent to the Buyer to his e-mail address only if the Buyer complies with the terms of this Offer on payment of the Ticket price. 9.4. The Buyer is obliged to print the Electronic Ticket independently and at his own expense. When printing the Electronic Ticket, the Buyer must ensure the proper quality of the printing of the Electronic Ticket (readability of all details). In case of failure to fulfill or improper fulfillment of the obligation established by this clause, the Buyer is fully responsible for such actions (omission), including in the event of the Event Organizer's refusal to allow entry to the Event due to improper printing of the Electronic Ticket. 9.5. The Buyer has the right, if permitted by the Event Organizer, to present the Electronic Ticket stored in the memory of a technical device belonging to the Buyer when entering the Event, provided that such device allows the document to be displayed for control (scanning) by the access control system at the Event venue. 9.6. The Buyer is solely responsible for the preservation and protection of the Electronic Ticket Barcode from copying. In the event of copying (loss, etc.) of the Barcode, access to the Event will be opened only once for the Ticket that was presented for scanning first (these conditions also apply to printed tickets). 9.6.1. The Buyer agrees that if he fails to save the Barcode from copying, in this case the Organizer does not bear any responsibility for the attendance of the Event by the person who first reported the Barcode and is not the Buyer or Spectator.
10.1. The Order, in terms of concluding the Agreement for the provision of services, is considered not to have been executed and does not require additional actions from the Buyer and the Organizer to cancel it (termination, termination), if: The Buyer has not confirmed to the Organizer his consent to purchase the Ticket of his choice (clause 5.3.2). 10.2. The Order is considered to be canceled at the initiative of the Buyer, and the obligations of the parties under the Agreement for the provision of services concluded between the Organizer and the Buyer are terminated, if: 10.2.1. The Buyer has not paid the Ticket Price after the Organizer has confirmed the possibility of purchasing the Ticket, when ordering by the Buyer through the Site; 10.2.2. The Spectator did not arrive at the Venue at the scheduled start time of the Event and/or violated the Rules of Staying at the Venue/at the Event, in connection with which he was not admitted to the Event, or was removed from the Venue by the Organizer's or the Venue's employees before the end of the Event, and/or lost the Ticket, and, as a result, was unable to receive the services in full or in part. In this case, the Ticket Price paid by the Buyer is not refundable. 10.3. The Order, in part of clause 3.1.1. of this Offer (Service Agreement) is considered canceled at the initiative of the Organizer, and the obligations of the parties under the Service Agreement concluded between the Organizer and the Buyer are terminated if: 10.3.1. The Organizer canceled its Event (which it reported openly and publicly or notified the Buyer about); 10.3.2. The Organizer did not hold the Event at the place and time specified in the Ticket, as a result of which the Buyer, who arrived on time at the Establishment where the Event was to be held, was unable to receive the services ordered by him due to the Organizer's fault; 10.3.3. After purchasing the Ticket, the Organizer postponed the date of the Event, or made other critical changes to the Event specified in the Ticket, which it announced openly and publicly and/or notified the Buyer, except for cases where the postponement of the date of the Event is a consequence of force majeure circumstances that arose after the conclusion of this Offer and which the Parties could neither foresee nor prevent by reasonable measures, if the Buyer did not agree to such changes and wishes to return the Ticket to the Organizer without exchanging it for another Ticket of the Organizer. 10.4. In the cases specified in clause 10.3. of this Offer, the Buyer who has not received the service has the right to demand from the Organizer a refund of the Nominal Price of the Ticket in accordance with the terms of Section 11. In this case, the cost of related services provided by the Organizer is not refundable.
11.1. Refund of funds to the Buyer shall be made only in cases of cancellation by the Organizer of the Event, except for cancellation for the reasons set out in clause 13. 11.1. The Organizer shall refund to the Buyer only the Nominal Value of the Ticket. 11.2. Procedure for refunding money to the Buyer in case of payment for the Order (Tickets): The Buyer undertakes to fill out the form provided by the Organizer for a specific Event, adding (a photo and/or a scanned copy) a statement containing the surname, patronymic, registration number of the taxpayer's account card according to the State Register of Individuals - Taxpayers (TIN) of the person applying, the name of the Event, the number of Tickets (their Barcode), the Nominal Value of the Tickets and the bank card number (indicating the full name of the card holder - the funds will be transferred to the specified card), date and signature, as well as a copy of a document confirming the identity. 11.3. By placing an Order, the Buyer confirms that he is fully familiar with and understands the grounds for its cancellation, termination of concluded contracts, refusal of the Organizer's services and that such conditions satisfy him and are accepted by him without any reservations. The Buyer does not have the right to refund the Ticket Price paid by him using payment systems by declaring such payment invalid, including due to the Organizer's failure to provide him with services.
12.1. When placing an Order, the Buyer provides the Organizer with his/her Personal Data and/or personal data of other persons (Spectators, etc.) - when ordering a Ticket through the Site. By providing such personal data, the Buyer grants the Organizer an indefinite, irrevocable and free of charge right to process them in any way, including but not limited to, by collecting, accumulating, owning, storing, adapting, changing, updating, using, destroying such personal data. These actions can be carried out in the following ways: in documentary, electronic, or oral forms. 12.1.1. If the Buyer provides the Organizer with personal data of other persons when placing an Order, the Buyer hereby confirms that he/she has previously received from them the appropriate permission to transfer to the Organizer, indefinitely store, use and process their data by the Organizer. The right to use and process personal data received from the Buyer includes, among others: the right of the Organizer to send advertising (billboards) to the received addresses, telephone numbers and e-mail (e-mail). 12.2. The processing and use of the Buyer's personal data is carried out in accordance with the legislation of Ukraine (including but not exclusively in accordance with the Law of Ukraine "On Personal Data Protection" No. 2297-VI of 01.06.2010). The Buyer grants the Organizer an indefinite, irrevocable and free of charge right to process and use his personal data in connection with the provision to the Buyer of the Services stipulated by this Offer, including for the purposes of receiving by the Buyer advertising messages about the event, tickets for which are sold by the Organizer. Due to the fact that the processing of the Buyer's personal data is carried out in connection with the execution of the contract concluded under the terms of this Offer, the Buyer's separate consent to the processing of his personal data is not required. The term of use of the provided personal data is indefinite. The Buyer guarantees and is responsible for the fact that the data specified in the Order is voluntarily provided by them and third parties when issuing the Ticket, and all these persons are familiar with and agree to the terms of this Offer.
13.1. The Parties are exempt from liability for full or partial failure to fulfill their obligations under this Offer, if such failure was a consequence of force majeure circumstances that arose after the conclusion of this Offer and which the Parties could neither foresee nor prevent by reasonable measures. 13.2. Force majeure circumstances (force majeure circumstances) are extraordinary and unavoidable circumstances that objectively make it impossible to fulfill obligations stipulated by the terms of a contract (contract, agreement, etc.), obligations under legislative and other regulatory acts, namely: threat of war, armed conflict or serious threat of such a conflict, including but not limited to enemy attacks, blockades, military embargoes, actions of a foreign enemy, general military mobilization, military actions, declared and undeclared war, actions of a public enemy, riots, acts of terrorism, sabotage, piracy, disorders, invasion, blockade, revolution, rebellion, uprising, mass unrest, introduction of a curfew, quarantine established by the Cabinet of Ministers of Ukraine, expropriation, forced removal, seizure of enterprises, requisition, public demonstration, blockade, strike, accident, unlawful actions of third parties, fire, explosion, long interruptions in transport operations, regulated by the terms of relevant decisions and acts of state authorities, closure of sea straits, embargo, ban (restriction) of export/import, etc., as well as those caused by exceptional weather conditions and natural disasters, namely: epidemic, severe storm, cyclone, hurricane, tornado, storm, flood, accumulation of snow, ice, hail, frost, freezing of the sea, straits, ports, passes, earthquake, lightning, fire, drought, subsidence and landslide, other natural disasters, etc. 13.3. The presence and duration of Force Majeure circumstances is confirmed by a certificate of the Chamber of Commerce and Industry of Ukraine of the established sample. 13.4. The Buyer agrees that if the Organizer, due to Force Majeure, postpones the date of the Event, then in this case the money paid for the Ticket to the Buyer will not be returned, while all Tickets remain active and valid for the new Event. 13.5. If the Organizer held the Event for which the Buyer purchased a Ticket, but the Buyer/Speechperson was unable to attend the Event due to force majeure, illness, fear, delay, traffic jams, accidents, road/passage closures and other restrictions that gave the Organizer the right to prevent the Spectator from entering the Facility, or other reasons beyond the Organizer's control, the Service Agreement is considered duly executed, and the Nominal Value of the Ticket to the Buyer is not returned (compensated).
14.1. The Organizer is liable to the Buyer for failure to provide services within the framework of the concluded Agreement for the provision of services. In any case, the Organizer's liability for the provision of services to the Buyer is limited to the Nominal Value of the Ticket purchased to receive such services. 14.2. The Parties are not liable for the inconsistency of the quality of services with the subjective expectations of the Buyer, which are not stipulated in this Offer and are not specified in the Ticket. The Buyer understands and agrees that his emotional and aesthetic impressions of the services received may not correspond and do not coincide with his subjective expectations, which were formed on the basis of information that was not distributed by the Organizer and not at his request (unofficial posters, reviews of critics, or other viewers), and therefore, such inconsistency and discrepancy is not considered improper provision of services. 14.3. The Buyer agrees that disclosure (loss, etc.) of the Barcodes (which are applied to the Ticket) may result in the loss of the opportunity to use the specified Ticket. The Organizer shall not be liable for the attendance of the Event by the person who first reported the Barcode and is not the Buyer and/or his representative. 14.4. The Organizer shall not be liable for any losses and moral damages incurred by the Buyer as a result of misunderstanding and/or misunderstanding of the information on the procedure for placing/paying for the Order. 14.5. The Organizer shall not be liable for the actions/inaction of banks, payment systems and for delays associated with their work.
15.1. Disputes arising during the performance of the Agreement under the terms of this Offer shall be resolved in accordance with the claim procedure. The claim shall be submitted to the Organizer in writing with the attachment of documents substantiating the claims made, within a period of no more than 10 (Ten) banking days from the date of the cause of the dispute. The submitted claim shall be considered by the Organizer within a period of no more than 10 (Ten) banking days. 15.2. If any disputes arising from or in connection with this Agreement, including those relating to its performance, violation, termination or invalidity, cannot be resolved through negotiations, then such disputes shall be considered in accordance with the current legislation of Ukraine in court at the location of the Organizer. 15.3. All and any disputes between the Buyer and the Organizer arising from the Service Agreement shall be considered in court at the location of the Organizer. 15.4. On all other issues not provided for in the Offer, the Parties shall be governed by the legislation of Ukraine. 15.5. This Agreement shall be governed and interpreted in accordance with the legislation of Ukraine. Issues not regulated by this Agreement shall be resolved in accordance with the current legislation of Ukraine. 15.6. Recognition by a court of any provision of this Agreement as invalid or unenforceable shall not be a ground for the invalidity or non-enforcement of other provisions of this Agreement.
